PRIVACY SHIELD

Jolokia Corporation complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom and Switzerland to the United States. Jolokia Corporation has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. The Federal Trade Commission (FTC) has jurisdiction over Jolokia Corporation's compliance with the Privacy Shield. .

Personal Information

Jolokia's collection of personal information depends on the type of service, support or inquiry and may include your name, address, ip address, telephone number, fax number, email address, dates of service, types of service, payment history, manner of payment, amount paid, dates of payments, credit card or other payment information. Financial information is only used to bill for the products and services provided. When gathering personal information we use encrypted communications and this can be verified by security information displayed by your web browser.

Cookies and Tracking

Internet browsers come with a built in storage facility used by websites to help recognize you. This information is stored in a `cookie´. We may use cookies to save preferences, login information, to provide a customized experience and to assist us with statistical analysis of how our services are being used. We may utilize cookies or pixel tags in external email campaigns to allow us to measure the effectiveness of our campaigns and to provide more focused messaging to our customers. You can disable use of cookies anytime in your browser, but please understand that this will degrade or disable services in some situations.

Customer Surveys

We periodically conduct surveys of our customers. Participation in these surveys is completely voluntary. Any personal information provided in these surveys with remain confidential even if conducted by a third party.

Social Media

Use of `likes´ or other features of Social Networking will cause the pertinent Social Network and, in almost all cases, other associated entities of those Social Network sites to collect information on you. Data and Information Submitted to Third Parties

Jolokia does not submit your personal information to third parties, but does occasionally use third party services that may gather such information. In that case, the third party, at a minimum follows the standards described in this Privacy Policy. This Privacy Policy, however, does not apply to data or personal information gathered by customers of our services. Please refer to the specific customer's privacy policy to determine how they use and protect your data when submitted to them using our services. Jolokia may use aggregated data for statistical purposes and this data may be submitted to third parties for further analysis and use.

Additionally, Jolokia cooperates with official government and law enforcement requests. We may disclose any and all personal information if the request is deemed official, due process has been followed properly and we believe that it is necessary or appropriate to respond to claims and legal processes, to protect your property and rights, or the property and rights of a third party, to protect the safety of the public or any person or to stop activity that we consider illegal or unethical. Jolokia is liable for appropriate onward transfers of personal data to third parties.

Security

Jolokia maintains secure connections for any personal information submitted to us. Where necessary, Jolokia additionally encrypts data while at rest. Our data centers and offices use security measures including, but not limited to: physical, electronic or procedures designed to safeguard and secure information we collect.

Access

To update or remove any personal information submitted to Jolokia, please use the appropriate web portal for that service or request removal by emailing support@jolokia.com. Jolokia also maintains opt-out measures on any mailings we send that are not directly related to the maintenance or support of our customers service, we strongly encourage using these mechanisms should you receive an undesired communication from us.

Changes to this Policy

Jolokia reserves the right to revise, amend or modify this Privacy Policy at any time and in any manner. Changes to the policy will not affect how we handle data received prior to the policy change. We do, however, encourage you to review this policy periodically for the latest information.

Enforcement and Dispute Resolution

This policy is periodically reviewed and updated for accuracy. For complaints or questions concerning this policy please contact support@jolokia.com. We will investigate said complaint, respond within 30 days and resolve the dispute in the manner that best complies with the spirit of this Privacy Policy. Should we be unable to resolve the complaint directly, we agree to participate in the dispute resolution procedures set forth by JAMS. If it is concluded that Jolokia did not comply with this Policy, we will take the required steps to address the issue and ensure our future compliance. In compliance with the Privacy Shield Principles, Jolokia Corporation commits to resolve complaints about our collection or use of your personal information.  EU the UK and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Jolokia Corporation at: support@jolokia.com.

Jolokia Corporation has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit JAMS for more information or to file a complaint. The services of JAMS are provided at no cost to you.

Under certain conditions EU the UK and Swiss individuals may seek binding arbitration by providing notice to us in the manner indicated in ANNEX I to the EU - U.S. Privacy Shield Principles, available online, and following the procedures set forth in such ANNEX I. Jolokia is a company located outside of the European Union. In order to comply with Article 27 GDPR, Jolokia has appointed GDPR-Rep.eu as representative in the European Union.
